“Supply, Installation and Construction Works for the reconstruction of water supply distribution pipes and replacement of pumps for the object “Reconstruction of water supply networks of CCE “Berdychivvodokanal” of Berdychiv city”

This Invitation for Tenders follows the General Procurement Notice dated 20.10.2022 for NEFCO NIP Ukraine Water System Modernisation Programme which was published on the Procurement Notices section of NEFCO’s website (https://www.nefco.int).
City Communal Enterprise “Berdychivvodokanal” hereinafter referred to as “the Employer”, intends to use part of the proceeds of financing from the European Union (EU) through the Fund Manager, Nordic Environment Finance Corporation (NEFCO), and own co-financing towards the cost of the project “Reconstruction of the Water Supply Facilities of CCE “Berdychivvodokanal” of the city of Berdychiv”. The project is co-financed by the EU Neighborhood Investment Platform (NIP), an EU facility stemming from the financing options offered by the European Neighborhood Instrument (ENI) Regulation, that approved a grant to support the NIP Ukraine Water Modernisation Programme (NIP grant).
The Employer now invites sealed tenders from tenderers for the following contracts to be funded by NIP grant funds and co-financing of the city for “Supply, Installation and Construction Works for the reconstruction of water supply distribution pipes and replacement of pumps for the object “Reconstruction of water supply networks of CCE “Berdychivvodokanal” of Berdychiv city”, including:
- Lot 1 - BERDYCHIV-C1: Financed by the city: Supply, Installation and Construction Works for the reconstruction of water supply distribution pipes;
- Lot 2 - BERDYCHIV-G1: Grant-financed Plant and co-financed by the city: Supply, Installation and Construction works for Replacement of pumps in 2-nd lift water supply pumping stations (WPS) and replacement of pumps in water supply booster pumping stations (BPS).
Tendering for contracts that are to be financed by EU grant financing is open to firms/individuals from any country.
Tenders are invited for the full scope of work. Tenders submitted only for a part of the works will be rejected.
The successful Tenderer will be required to sign two contracts, one for each source of financing - the NIP grant; and cofinancing from the city budget. The value of each contract will be determined by the Employer after identifying the winner by grouping its proposed prices into respective price schedules for each contract. The total value of both contracts will be equal to the total price of the successful tender (with VAT).
Tenders should be priced in Euro. The value of the contract to be financed by the municipal budget will be converted into Hryvnia at the exchange rate of the National Bank of Ukraine at the date of contract award letter from the Employer.
The contract that is to be financed by the NIP grant will be tax exempt in accordance with Resolution of Cabinet of Ministers of Ukraine No.153 (with changes). The respective amount of VAT will be excluded from this contract’s price.
To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:
- Tenderers shall meet the eligibility requirements set forth in Instructions to Tenderers;
- The Average Annual Turnover over the last three (3) years (2020-2022) exceeded EUR 1,500,000 equivalent. In case of tender submitted by JVCA, the leading partner should demonstrate at least 50% compliance with the requirement;
- The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the production cash flow for the contract estimated as not less than forty (40) percentages of proposed Tender price taking into account the Tenderer's commitments in other concluded contracts or/and contracts, which shall be concluded. If the Tender is submitted by JVCA, the leading partner shall demonstrate at least 50% compliance with this criterion;
- The Tenderer has satisfactorily supplied and completed for the period 2018-2022:
- or Lot BERDYCHIV-C1 two (2) contracts as main contractor for supply and installation of water supply distribution pipes in urban conditions, each with a total length of at least 1 km, including distribution pipes with a diameter (DN) of at least 200 mm;
- for Lot BERDYCHIV-G1 two (2) contracts as main contractor for new construction or reconstruction of water supply pumping stations including installation of main process pumps with capacity of at least 60 m3/hour;
In case of tender submitted by JVCA, the leading partner shall demonstrate at least 50% to the above-mentioned requirement and JVCA partner shall demonstrate at least one (1) contract in accordance with the requirements for Lot Berdychiv-C1 or Berdychiv-Gl;
- Non-performance of contract by the Tenderer (including partners/members of JVCA if appropriate) did not occur during the last three (3) years (2020-2022) based on information provided in Section III “Tender Forms” (the Employer reserves the right to check the correctness of the reported information by using other sources);
- All pending litigations against the Tenderer (including partners/members of JVCA if appropriate) shall in total not represent more than thirty (30) percentages of the Tenderer’s net worth;
- The Tenderer (single legal entity or JVCA partner or designated subcontractor) shall demonstrate availability of all personnel for implementation of all necessary works under the Contract;
- The Tenderer must demonstrate that it has the personnel for the key positions that meet the Qualification requirements set forth in Tender document;
The Employer reserves the right to cancel all tenders in the event of non-approval of grant funding.
During the preparation of tender the Tenderers should take into account that works under this Contract will tentatively start in March 2024 and should be completed not later than 30 November 2024.
Tender documents may be obtained from the office at the address below free of charge upon a written request from a prospective Tenderer. Upon receiving the written request from prospective Tenderer, the documents will be promptly dispatched electronically in PDF and MS Word format, however, no liability can be accepted for their non-delivery or late delivery. In case of discrepancies between the PDF and Word versions of the document, the PDF version shall prevail.
All tenders must be accompanied by a Tender-Securing Declaration. The form of Tender-Securing Declaration is provided in the Tender documents. The main purpose of providing Tender-Securing Declaration is to ensure that the tenderers are serious about their participation.
Tenders must be delivered to the office at the address below on or before 14:00 on 19 February 2024 (Kyiv time) at which time they will be opened in the presence of those tenderers’ representatives who choose to attend.
A pre-tender meeting for Tenderers with Employer representatives to discuss technical and procedural issues will be held online at 11:00 on 18 January 2024 (Kyiv time).
